Software License Terms:

The use of any software that is made available to download from this server is governed by the appropriate license terms. The appropriate license terms are either set out in the appropriate license agreement included with the software or, if no such agreement is included, the software license terms set out herein in the chapters License Agreement and Warranty apply. The software is made available for downloading solely for subsequent use according to the appropriate license agreement and the instructions for the use of the software. The software must not be installed unless you agree to the appropriate license terms.

BY INSTALLING THE SOFTWARE YOU AGREE TO THE APPROPRIATE LICENSE TERMS.

K²-Photogrammetry and/or its suppliers own the copyright in the software that is made available to download from this server. Any reproduction or redistribution of the software or any part of it (not in accordance with the appropriate license agreement) is expressly prohibited by law and may result in severe civil and criminal penalties, and will be prosecuted to the maximum extend possible under the law.

WITHOUT PRIOR WRITTEN PERMISSION OF K²-PHOTOGRAMMETRY, REPRODUCTION OF THE SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED.

Updates and Upgrades:

DOS: You can start and use this software with the appropriate license and dongle of K²-Photogrammetry.

Windows 95/98/NT/2000/XP: You can start this software with any dongle of K²-Photogrammetry. It will report your license number and the license type.

You can use this software with the appropriate license and dongle of K²-Photogrammetry. If you like to upgrade or side grade your present program license to any other software of K²-Photogrammetry, send your order and report your license number and your present licensed K²-Photogrammetry software.

Please review the following terms and conditions carefully before using our software. By buying our software, you indicate your acceptance of such terms and conditions.

Our software consists of executable software and the appropriate dongle. In the following all together will be named as programs. The following agreement constitutes the complete and exclusive agreement between you and us. It supersedes and replaces any previous written or oral agreements and communications relating to this program. No oral or written information or advice given by any person will increase the scope of the warranty provided in this agreement, and you may not rely on any such advice or information. You obtain a license by purchasing. You may use the programs for your own purposes on your computer. You may copy the software for back-up or modification purposes. All copies must include the copyright notice. You may not sublicense the program to any third party. If you assign, allow or transfer possession of the program, any copy, modification or portion of the program to another party, your own license is automatically terminated. It will also terminate if you fail to comply with any term or condition of this license. You agree upon such termination to destroy the software completely together with all copies, modifications and portions in any form. 

Warranty:

We will remedy errors, which adverse the value of the programs seriously within a reasonable time. You have to proof the errors and to pass to us all data necessary to eliminate the defects. In any event you assume the entire cost of all necessary servicing, repair, or correction and the costs for shipping. Except as expressly set forth above, the programs are provided "as is" without warranty of any kind, either express or implied. The entire risk related to the quality and performance of the programs is on you. We do not warrant that the functions contained in the programs or the result will meet your requirements or that the operation of the program will be uninterrupted or error free. In no event we will be liable to you for any further damages, including any lost profits, lost savings, expenses or other incidental or consequential damages arising out of the use of or inability to use these programs, or for any claim by any other party. Our liability for claim of damages is restricted to malice aforethought and gross negligence.

Dongle:

The programs must not be used without the appropriate dongle. Manipulation of the dongle or execution without appropriate dongle will lead to unexpected and defective results. We are not liable for any damages caused by use of the program without dongle. Manipulations, opening or damage of the dongle will cause its unfit for use. The respective dongles will not be replaced.

Payment:

By ordering and purchasing the software you accept our invoice. All prices are quoted net, without discount and quoted in Euro. Currency of payment is Euro. Payment for the software has to be affected due to the terms of payment stated in the invoice and has to be forwarded to the bank and account number specified in the invoice.
